FAMILY FEES

We offer FREE ½ hour initial advice appointments.


Legal Aid

Upon review of your case and your circumstances we can advise as to whether you are entitled to Legal Aid. This will depend on the type of case you are involved in, the merits of your case and in some cases, your financial circumstances. In cases where the Local Authority issue Care Proceedings, the merits test does not apply and you are entitled to free Legal Aid, irrespective of your financial circumstances.

Fixed fees

If you are not entitled to Legal Aid, we can advise you of our charging rates. In appropriate cases we offer competitive fixed fees for advising, preparing documents for Court and representing you. Please contact your local office for full details.



PROBATE FEES

The loss of a loved one is an extremely difficult time. At Jackson Quinn we are here to help you through the process of dealing with their affairs. The exact costs of applying for a Grant of Probate and then administering the estate after obtaining the Grant will vary depending upon the individual circumstances of each matter.

David Woodhead, who is based at our Retford Office, is our expert in dealing with probate matters, and when you meet with David he will be able to identify with you the type of probate application you require and the likely costs involved. Costs will be calculated at hourly charging rates which vary from time to time but are currently £275.00 per hour plus 20% VAT.

Applying for a Grant of Probate

For obtaining a Grant of Probate in a straight forward estate, our fees can range from £950.00 plus 20% VAT (£1,140.00) to £2000.00 plus 20% VAT (£2,400.00). These estimated costs are on the basis that there is no inheritance tax payable and the executors do not need to submit a full account to HMRC. Complicating features which can increase the anticipated costs detailed above include:

• Where there is no valid will;

• Where you are unable to provide details of all of the assets in the estate as at the date of death;

• Where more information is required;

• Where there are potential claims against the estate.

Disbursements

Disbursements are costs we have to pay out to third parties on behalf of the estate. These will include the Probate Court fee of £303.00

Estate Administration

Administering an estate can be complex, and requires identifying all of the assets and paying inheritance tax, where necessary. Our costs for administering the estate will therefore vary depending upon the complexity of the matter. Factors that can affect our costs can include the number of beneficiaries, where the assets are held, whether there is a property to be sold, the number of bank accounts, and if there are any disputes about the division of assets.

For administering a straight forward estate our fees can again range from £950.00 plus 20% VAT (£1,140) to £2000.00 plus 20% VAT (£2,400.00), but these charges will increase depending upon the complexity of the estate and the issues involved. Our costs will include collecting in all of the assets, paying debts, taxes and administration expenses, producing estate accounts and accounting to the beneficiaries. We will meet with you at the outset to obtain all relevant information and provide you with an estimate tailored to the circumstances of the estate. If it appears this estimate is going to change as the matter progresses we will let you know at the earliest opportunity .

Work that is not included in the charges detailed above.

At Jackson Quinn we do not do work in contentious probate cases, where a claim is being made against the estate. If the value of the estate is such that Inheritance Tax was payable, then our costs will be higher than that detailed above due to the amount of work required to administer the estate.



PROPERTY FEES

Whether you are a first time buyer, moving on to a new home, re-mortgaging an existing property or buying an additional property as an investment, buying or selling a property can be extremely stressful. Buying and selling a property can be complex, with unforeseen situations arising along the way; at Jackson Quinn we have the expertise to ensure that your matter is dealt with efficiently, whilst being clear from the outset as to the fees for dealing with your case.

Below is the information regarding our fees and what this will cover:

Residential Sale and Purchase

Our average fees for the sale or purchase of a property can range from £600 plus 20% VAT (£600) to £1,000 plus 20% VAT (£1,200) for a straightforward transaction, for properties with a sale or purchase price of £500,000 or under. We will also charge an administration fee of £15.00 plus 20% VAT (£18.00) for processing an electronic money transfer fee.

These fees exclude disbursements which are costs we have to pay out to third parties and which are incurred by us when we are acting for you. Disbursements will vary from case to case, but can include, on a residential purchase:

• Search fees – these vary depending upon the Local Authority where you are purchasing your property but will be approximately £220.00

• HM Land Registry Fees – these vary depending on the purchase price of your property (a Land Registry fee scale is available on HM Land Registry’s website

• Electronic money transfer fees bank charges – £10.00 plus 20% VAT (£12.00)

• Bankruptcy searches – £2.00 per name

• Official Searches – £3.00

• Chancel Search (if required) – £10.00

There are some services and work that we may be required to do which are not included in our standard fees.  Please click here for Additional Matters which will incur additional charges should they be required within your transaction.
In addition, when you are buying a property, you will need to factor in paying Stamp Duty Land Tax; the amount due will very much depend on the purchase price of the property you are buying.

We will provide you with an individual costs estimate at the outset of your matter. The costs estimate that we will provide you with will set out clearly all of the fees that will be required to complete your transaction, to include on a purchase, registering the ownership of your property with the Land Registry and paying any Stamp Duty. If there are any unusual features of your transaction or complicating factors that will incur additional charges then we will notify you of those as soon as we become aware. Such factors could include:

• If part or all of the property is unregistered;

• If the legal title is defective;

• If planning permission or building regulation consent has not been obtained;

• If there is a delay in the provision of documentation.

ADDITIONAL WORK

 Our fixed fee which you have been quoted covers all conventional conveyancing work associated with your transaction. If other legal documents and/or legal services are required from the list below, the additional fees will become payable by you as follows:-

Remortgages and Transfer of Equities

Our costs will depend on a number of factors to include the type of property that you are wishing to re-mortgage or transfer, the complexity of the case, whether the property is freehold or leasehold and the nature of the instructions we receive from your lender.

For a typical re-mortgage our costs will be in the region of £500.00 plus 20% VAT (£600.00).

To act for you on a transfer of equity our average costs are in the region of £500.00 plus 20% VAT (£600.00)

These fees exclude disbursements which are costs we have to pay out to third parties and which are incurred by us when we are acting for you. Disbursements will vary from case to case, but can include:

• Search fees – these vary depending upon the Local Authority where your property is situated but will be approximately £220.00

• HM Land Registry Fees – these vary depending on the purchase price of your property (a Land Registry fee scale is available on HM Land Registry’s website)

• Electronic money transfer fees bank charges – £30.00 inclusive of VAT

We will provide you with an individual costs estimate at the outset of your matter. Our fees estimate will include all of the work that will be required to complete your transaction to include registration of the mortgage with the Land Registry, where applicable. If there are any unusual features of your transaction or complicating factors that will incur additional charges then we will notify you of those as soon we become aware.
